Terms of Service

1. Agreement to Terms

By downloading, installing, or using BetterMemo ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

BetterMemo is a mobile application that provides voice memo recording, AI-powered transcription, automatic categorization, task extraction, and organization features. The service includes both free and premium subscription tiers.

3. User Accounts

BetterMemo uses anonymous authentication. Your account is associated with a unique device identifier. You are responsible for:

• Maintaining the security of your device
• All activities that occur through your use of the App
• Backing up your data if desired through the cloud sync feature

4. Subscription and Payments

Free Tier

The free tier includes up to 5 voice memos with full AI transcription and categorization features.

Premium Subscription

Premium subscriptions provide unlimited memos and additional features. By subscribing, you agree to:

• Pay the subscription fee at the current rate
• Automatic renewal unless cancelled before the renewal date
• Manage your subscription through the App Store or Google Play

Refunds

Refund requests are handled by Apple App Store or Google Play according to their respective policies. We cannot process refunds directly.

5. Acceptable Use

You agree not to use BetterMemo to:

• Record conversations without proper consent where required by law
• Store or transmit illegal, harmful, or objectionable content
• Violate any applicable laws or regulations
• Attempt to reverse engineer, decompile, or hack the App
• Interfere with or disrupt the service or servers
• Use the service for any commercial purpose without authorization

6. Intellectual Property

Our Content: BetterMemo and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of all audio recordings and content you create using BetterMemo. By using the App, you grant us a limited license to process your content solely for providing the service.

7. Third-Party Services

BetterMemo integrates with third-party services including OpenAI, Supabase, and payment processors. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. TRANSCRIPTION ACCURACY MAY VARY BASED ON AUDIO QUALITY, ACCENTS, AND OTHER FACTORS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

10. Data Loss

While we strive to protect your data, we are not responsible for any loss of data due to device failure, app uninstallation, or other circumstances. We recommend enabling cloud sync for backup purposes.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by other means. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BetterMemo operates, without regard to conflict of law principles.
